Section 3. Para sa inyong kaalaman, ang panahon na itinatakda ng batas ay labinlimang taon (15) upang kayo ay makapagsampa ng kaso sa korte ukol sa pagkakaguho ng inyong bahay mula nang ito ay itayo. Depende sa dahilan ng pagkakaguho at kung nag-supervise ba o hindi ang engineer sa pagpapatayo nito, ang dapat na managot dito ay ang engineer na nagdisenyo ng inyong bahay o ang kontraktor na nagpatayo nito o pareho. Ayon sa Artikulo 1311 ng Civil Code of the Philippines, ang isang kontrata ay magkakaroon lamang ng bisa sa pagitan ng mga partido nito, kanilang mga assigns at mga tagapagmana, maliban na lamang kung ang mga karapatan at obligasyon na nilalaman ng kontrata ay hindi maaaring mailipat o kung may probisyon ang nasabing kontrata na hindi maaaring ilipat sa iba ang mga nasabing karapatan at obligasyon.

‘Power of eminent domain’

Nais bilhin ng aming local municipal government ang pagmamay-ari naming lupain upang gawing pampublikong daan. Ayaw naming ibenta ang nasabing lupain subalit mapilit ang munisipyo. Kung hindi raw namin ibebenta ito ay idudulog nila sa korte ang usapin. May karapatan po ba ang munispyo na sapilitang bilhin ang aming lupain?
