Court fines 38 Kadamay members P200 each for trespassing in 2017

THE Quezon City metropolitan trial court came up with a decision finding 38 members of the urban poor group Kalipunan ng Damayang Mahihirap (Kadamay) guilty of trespassing after they tried to reoccupy a 1,668-square meter lot along Apollo St. in Bgy. Tandang Sora last 2017.

While Branch 43 Judge Don Ace Mariano Alagar convicted them under Article 281 of the Revised Penal Code (RPC), prison time was waived. Instead, the Kadamay members were told to pay a P200 fine each.

The court understands that accused were driven by self-preservation under the circumstances and will thus impose the penalty of fine instead of imprisonment,” read the decision.

The Kadamay members tried to reoccupy a 1,668-square meter lot along Apollo street in Barangay Tandang Sora in 2017.

Trespassing charges were filed against them following inquest proceedings at the QCPD headquarters at Camp Karingal.
