THE Senate Electoral Tribunal (SET) has ordered Senator Aquilino “Koko” Pimentel III to comment on the petition filed against him after winning in the May 13 midterm elections.
The petition for quo warranto was filed with SET by Reymar Mansilungan of Mercedes, Camarines Sur and Efren Adan from Manila.
The petitioners urged the SET to invalidate Pimentel’s victory in the recent election. They claimed that this will be the third term of Pimentel if SET allowed him to occupy one of the 12 senate seats.
This is contrary to the Constitution mandates that a senator can occupy a post in the Senate for only two consecutive terms.
The petitioners believe that Pimentel has served his first term between August 2011 and June 2013 when he won his electoral protest against Senator Juan Miguel Zubiri and spent his second term from 2013 to 2019.
The notice to comment on the petitions were sent to Pimentel and signed by the nine SET members.
The SET is composed of Supreme Court Senior Associate Justice Antonio Carpio with members SC Justices Mariano del Castillo and Marvic Leonen, Senate Minority Leader Franklin Drilon, Senators Nancy Binay, Joel Villanueva, Manny Pacquiao, Richard Gordon and Antonio Trillanes IV.
