Suit filed vs extended Mindanao martial law

THE House opposition bloc, led by Albay Rep. Edcel Lagman, has filed a petition asking the Supreme Court to declare unconstitutional the third extension of martial law and the suspension of the privilege of the writ of habeas corpus in the entire Mindanao.

Petitioners Lagman, Reps. Tomasito Villarin, Teddy Baguilat, Jr., Edgar Erice, and Gary Alejano, all members of the Magnificent 7 opposition group, submitted
the petition.

They were joined by Liberal Party members Reps. Christopher Belmonte and Arlene “Kaka” Bag-ao.

The petitioners asserted that the Resolution of Both Houses No. 16 dated 12 December 2018 mocks the 1987 Constitution.

According to Lagman there is no reason to declare martial law again because rebellion does not exist and persist in Mindanao; public safety is not imperiled.

They added one-year extension unduly prolongs the martial law regime.

Likewise they stressed that Proclamation No. 216 which originally imposed martial law and suspended the writ in Mindanao has become functus officio and cannot anymore be extended.
