A network of digital advocates flagged the viral “screenshot gift” video for possible violations of Philippine privacy and cybercrime laws.
Digital Pinoys National Campaigner Ronald Gustilo said the uploader may be liable under the Anti-Photo and Video Voyeurism Act, the Data Privacy Act of 2012, and the Cybercrime Prevention Act.
Under existing laws, recording, sharing, or reposting private content without consent—including screenshots of private conversations—is illegal and may result in criminal liability. Violations of the Anti-Photo and Video Voyeurism Act are punishable by imprisonment of three to seven years and fines of up to ₱500,000, while the Data Privacy Act carries penalties of up to ₱5 million in fines and possible imprisonment, depending on the gravity of the offense. Additional liability may arise under the Cybercrime Prevention Act when online acts result in harassment, coercion, or reputational harm.
“Recording or exposing someone online without consent is not accountability—it is a rights violation with real legal consequences,” Gustilo said.
He stressed that acts of online exposure or public shaming should not be mistaken for justice.
“Beyond online debate and speculation, these laws provide clear protections against non-consensual recording and public exposure, and violations are treated as criminal offenses—not acts of justice nor mere lapses in judgment.”
Moreover, Gustilo added that consent cannot be assumed from prior relationships, private exchanges, or allegations.
“The law is clear: consent must be explicit, and privacy does not disappear because content went viral.”
He also warned that resharing unlawfully obtained content may expose others to liability.
“As digital platforms increasingly shape public discourse, we reiterate our call for stronger digital literacy, responsible online behavior, and consistent enforcement of privacy laws. Our digital spaces should not become instruments of punishment or humiliation. Rights offline remain rights online.”
